1. Introduction Starlight Media (Pty) Ltd with registration number 2017 / 351007 / 07 (“promoter”, “we”, or “us”) is running a promotional competition. By entering your Star into the competition you can win amazing prizes.
By entering this great competition, you will also be helping our chosen charities as we will be donating 30% of our proceeds towards the charities chosen by our People’s Choice winners.
2. Definitions In this Agreement
2.1 entry means the entry form (in electronic format) that a participant can access through www.star-pet.co.za and that you must fill out completely along with the photograph of your Star to stand a chance to win a prize.
2.2 participant or you means the person who: • fills out a entry form on star-pet.co.za; • submits the required photo’s and descriptions of your Star for a valid entry.
2.3 promoter means Starlight Media (Pty) Ltd or its agencies used to promote this competition.
2.4 Star means the entrant that you are entering into the competition (i.e. your pet or baby)
The competition will run from the first day to the last day of the calendar month and the draw will take place no later than the 7th day of the month following the competition. (for example if you enter your Star into the November competition, the winner will be announced by the 7th of December.).
4.1 The competition is conducted by the promoter and its third party contractors.
4.2 No one who is a director, employee or agent of or consultant to us or who is a spouse, life partner, close family member, business partner, or associate to a director, employee or agent of or consultant to us may take part or enter the competition. This includes the chosen benefiting charities.
4.3 This competition is only open to legal residents of the South Africa aged 18 years or over.
4.4 You must have a valid South African delivery address and ID when claiming a prize.
4.5 You must have the legal capacity to enter your Star into the competition. By entering this competition you confirm that you have the required authority to enter your Star.
4.6 Entry into this competition is regarded as acceptance of these terms and conditions.
5. How to enter
5.1 To enter you must complete all the steps required for a valid entry in terms of clause 5.3 below and any other requirements in these rules.
5.2 You may only enter your Star once, but you can enter more than one Star.
5.3 For an entry to be valid, you must: • fill in the entry form completely and truthfully; • submit a photograph of your Star; • submit the name of your Star along with a short description of your Star.
5.4 We are not liable for any technical failure that may result in an entry not being successfully submitted.
5.5 Consumer Protection Act. Under the Consumer Protection Act (CPA), we need to keep records of all the people used to promote the Promotional Competition. We (or one of our subcontractors or affiliates) will keep this agreement for three years to serve as the record as required by the CPA.
6. No liability for Facebook
6.1 The competition is in no way sponsored, endorsed or administered by, or associated with, Facebook.
6.2 You release Facebook and Twitter of all liability for any damage you may suffer. You will be giving information to us and not to Facebook.
7.Promotional competition Reward

7.3 Limitation to using your prize. Certain conditions may apply to redeeming your prize (for example peak time restrictions and so on). We will not be responsible for any loss or damage caused by you not being able to use the prize at a time that is convenient for you.
8. Prize winner selection and publicity
8.1 Choosing the winning Star. The prize winners will be chosen as follows after the end of the competition.

8.3 How will you know if you have won. Each winner will be contacted telephonically, through email, or SMS after they have been selected. We will attempt to contact winners three times during a 72 hour period. If we cannot contact the winner during this period we will draw another winner. Winners who have not given the promoters the correct details will forfeit the prize.
8.4 We may ask winners to take part in publicity connected to this competition. Winners grant permission for us to use their names and photographs in any advertising and promotional material for this competition. You may ask us to remove your name or refuse to take part in any publicity.
8.5 No payment. You will not receive any payment for taking part in the competition, or taking part in any media format related to it.
8.6 The prizes are not transferable. You cannot ask us to give you another prize of similar value or to pay out the value of the prize. We may substitute any prize with another prize of similar value. 8.7 Disqualification. If your Star has won one of our competitions in the last 12 months you are not eligible to enter them until 12 months has elapsed. Their entry will not be entered into the competition.
8.8 Forfeiture. If you do not claim your prize within one month, you will forfeit it and we may re-award it.

9. Dispute resolution
9.1 Arbitration. If there is any dispute, the parties must refer the dispute within 15 business days to arbitration (including any appeal against the arbitrator’s decision) under AFSA’s latest rules for expedited arbitrations.
9.2 CPA dispute resolution. Despite 9.1, any party may use other dispute resolution channels provided for by the CPA or other law.
9.3 Severability. This clause is separate and divisible from the rest of this agreement and stays effective even if this agreement ends or is invalid.
10. General Rules
10.1 No liability. By taking part in this competition you agree that you will not hold us liable for any losses, harm, damages, injury, claims or actions related to this competition.
10.2 Force majeure. No party will be responsible for any breach of this agreement caused by circumstances beyond its control.
10.3 Changing the rules. These rules, including the duration of the competition, can only be reasonably changed (or superseded) by us in a written revision to these rules posted on the competition website or any other potential official competition communication methods we use to reach a majority of potential participants.
10.4 Tax. Income or other taxes relating to the prizes, if any, are the sole responsibility of the prize winner.
10.5 Governing laws. South African laws govern this competition.
10.6 Use of personal information. Participants understand and agree that in order to offer the competition, the promoter must collect and use personal information about them.
10.7 Termination of the competition. If we need to, because of legislative or regulatory reasons, we may terminate the competition immediately and without notice. If this happens you will not have any claim against us, because of this.
